This case describes the challenges in protecting the intellectual property (IP) rights of TRX, a company that sells a proprietary training system called the Totalbody Resistance Exercise System based on suspension training. After six years of steady sales growth, TRX sales leveled off, primarily due to online sales of counterfeit and counterfeit products. Should TRX sue a copycat manufacturer who aggressively steals TRX’s business by producing an inferior copy of the product and selling it online at a discounted price?
