This case describes the circumstances that led the Denver, Colorado City Council to consider outdoor advertising restrictions for the medical marijuana industry in 2012. It was written from the perspective of Michael Elliott, CEO of the Medical Marijuana Industry Group (MMIG), a trade association representing more than fifty Colorado businesses. The MMIG was founded in 2010 “to protect and advance Colorado’s medical marijuana regulatory framework, serve as a responsible resource for legislators, and protect the rights of medical marijuana patients.” The decision faced by Elliott and the MMIG was to support the council’s proposed motion (ban outdoor advertising within 1,000 feet of schools, parks, and daycare centers), reject the motion, or present an alternative proposal to regulate outdoor advertising in Denver.
